In searching for out-of-print films on disc on Amazon, I've found a few listings that say they "make" the disc when the order is placed. Of course they don't describe the "source" print which is probably an old vhs tape. I think my copy of The Velvet Vampire was "made"/copied when I ordered it. This "process" reminds me of the days when I used to order "import" movies on vhs. Most were copied from laser discs and some were just recordings of foreign tv broadcasts of the movies. Others might have been dubs of European or Asian-only vhs releases. If it's out of print or was never released in your region, it's probably been "burned" from an old vhs tape.
I don't know if this makes it counterfeit/illegal, but my guess would be that it is. I guess it's also conceivable that someone could own a license for a film and make their own copies for sale rather than manufacturing them?
